EnrightSculpture Workshop Liability and Photo Release Waiver - Required to Read before purchase

 

Liability Section 

 

Disclaimer: Brian Enright (“ENRIGHTSCULPTURE”) and Jamie Does (“JAMIE DOES CREATIVE”) are not responsible for any injury (or loss of property) to any person suffered while attending, participating, playing, practicing, or any other way involved in cooperative or recreational activities at 4925 Seaport Drive, Richmond Ca (“STUDIO”) for any reason whatsoever, including negligence on the part of ENRIGHTSCULPTURE or JAMIE DOES CREATIVE, its teachers, instructors, volunteers, landlord or employees. Please read this release carefully as it relates to your legal rights. 

 

This Waiver and Release of Liability Form must be completed and signed by the enrolled student (“STUDENT”) before participation in ENRIGHTSCULPTURE / JAMIE DOES CREATIVE instructional class (“CLASS”). In consideration for receiving permission to enroll and participate in CLASS. 

 

I hereby acknowledge that activities at ENRIGHTSCULPTURE / JAMIE DOES CREATIVE involve risk of accidents or personal injuries and agree to release, waive, discharge and covenant NOT to sue and to hold harmless ENRIGHTSCULPTURE / JAMIE DOES CREATIVE, its board members, teachers, contractors, volunteers, administrative officers, employees and any other associated personnel including owners or landlords of the premises utilized by ENRIGHTSCULPTURE / JAMIE DOES CREATIVE, of and from any and all claims, actions and damages for accidents, personal injuries, emotional distress, disabilities or death that STUDENT has or may have sustained as a result of participation in this CLASS. 

 

I am aware that some ENRIGHTSCULPTURE / JAMIE DOES CREATIVE classes and activities may involve working with materials known to be harmful to the State of California. I understand that classes and activities involve certain risks for the STUDENT, including but not limited to, emotional distress, physical injuries, or death. I acknowledge that STUDENT is voluntarily participating in the classes and activities with knowledge of the danger involved and the STUDENT hereby agrees to accept any and all inherent risks of emotional distress, personal injury, or death. 

 

The STUDENT is fully aware of these risks, and in consideration of the STUDENT’S participation, the STUDENT on behalf of themself, their heirs, assigns, executor administrator and representatives, hereby release and hold harmless ENRIGHTSCULPTURE / JAMIE DOES CREATIVE, its Board members, teachers, contractors, volunteers, administrative officers, employees and any other associated personnel including owners or landlords, from any and all liability, loss, damage, costs, claims and/or causes of action, including but not limited to all bodily injuries, death and property damage arising out of or relating to my attending and participating in the classes and activities of ENRIGHTSCULPTURE / JAMIE DOES CREATIVE. 

 

• I authorize ENRIGHTSCULPTURE / JAMIE DOES CREATIVE to seek emergency medical treatment for STUDENT at an available medical facility at my expense. 

 

• I agree to take full financial responsibility for any damage to ENRIGHTSCULPTURE / JAMIE DOES CREATIVE facilities or equipment caused by STUDENT. 

 

• I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of California and agree that if any portion is held invalid, the remainder of the waiver will continue in full legal force and effect. I further agree that this agreement shall be governed by the laws of California. 

 

Safety Equipment

 

We require that you wear long pants and sleeves of all natural fibers (cotton, leather, canvas, wool, etc.). Materials that do NOT work include fleece, polyester, nylon or other synthetic fabrics. Shoes must be covered toes in the shop at all times. If you have them, work boots are preferable. We will provide the following safety gear: Eye protection, leather gloves, ear protection and welding helmets. 

 

Photo Release Section

 

STUDENT also gives permission to ENRIGHTSCULPTURE / JAMIE DOES CREATIVE to take photographs of me and use them for any legal purpose. 

 

• I understand that I will not be paid for these photographs and have no rights to them. 

 

• I affirm that I am the STUDENT and I am freely signing this agreement. I have read this form and fully understand that by signing this form I am agreeing that I will abide by all rules and guidelines set forth by ENRIGHTSCULPTURE / JAMIE DOES CREATIVE. I further understand that by signing this form, I am giving up legal rights and/or remedies, which may be available to me against ENRIGHTSCULPTURE / JAMIE DOES CREATIVE, or any of the parties listed above. 

 

By checking the box on the next page for the, "I have read and understand the EnrightSculpture Workshop Liability and Photo Release Waiver" you are agreeing to the terms of the above liability and photo release waiver and to wear and bring the appropriate safety gear.
